To conduct a gap analysis of the Lagos State draft legal framework of 2017
To align the provisions of the Lagos State WASH legal framework (EMP 2017) with the current (2022/2023) WASH policy.
To ensure the sector’s legal framework meets international best practices with respect to autonomous regulators, incentivised private sector participation, and an effective, structured and efficient institutional framework.
Conduct gap analysis of the Lagos State draft legal framework of 2017.
Update the Lagos State WASH legal framework (EMP 2017) and ensure consistency in use of terminologies and reform concepts in the legal framework.
Facilitate the alignment of the Lagos State legal framework (EMP 2017) to be consistent with the presently approved WASH policy.
Ensure the Legal Framework addresses the issues of unbundling of LWC, sectoral regulatory conflicts, and private sector participation.
Examine the framework for its suitability to meet contextual short-term, mid-term, and long-term challenges.
Examine the amenability of the framework to international best practices.
Ensure provision for corporate governance structure that provides risk management and effective oversight functions.
Introduce provisions for building private partnerships and private sector participation to accelerate urban water and sanitation service delivery, and WASH provision for the urban poor.
Identify any further gaps and provide solutions to address the loopholes.
Propose roll-out plan and a strategy to implement same.
Present findings of analysis with LUWASH and key decision sector stakeholders of Lagos State
Expected Deliverables:
An Inception report detailing methodology and tools including a well-defined work plan and resources requirements.
Findings of the gap analysis of Lagos State WASH legal framework (EMP 2017)
Consolidated report of analyzed draft WASH legal framework for comments by key MDAs/ stakeholders (Ministry of Environment and Water Resources, Ministry of Energy and Mineral Resources, LWC, LAWARCO, and LSWMO etc.).
Final draft Lagos State WASH Bill/an amended EMP version 2024.
Qualifications
A Bachelor’s degree (LLB) or Masters degree (LLM) in Law, or related field
10 years of working experience in legislative and public policy drafting – experience related to water and sanitation preferred
Demonstrated experience in developing/amending public sector institutional legal framework within local contexts to conform with international best practice and standards. WASH related experience preferred.
Experience in corporatizing public owned enterprises.
Experience as a Water Snitation and Hygiene (WASH) corporate/ business-oriented practitioner.
Experience in Public, Private, Partnership initiatives.
Experience in gender and inclusion and its related activities.
